OpenSSD is a file sharing service provided "AS-IS" and "AS-AVAILABLE" without any warranties, express or implied. We make no guarantees regarding:

• Service availability, uptime, or reliability
• Data integrity, security, or preservation
• File retention or backup
• Service performance or speed
• Error-free operation

3. No Warranty

THE SERVICE IS PROVIDED WITHOUT WARRANTY OF ANY KIND. We disclaim all warranties including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Title
• Accuracy or completeness

4. User Responsibilities

YOU ARE SOLELY RESPONSIBLE FOR:

• All content you upload, share, or distribute
• Compliance with all applicable laws and regulations
• Obtaining necessary rights, licenses, and permissions for your content
• Backing up your own files - we provide no backup service
• Security of your account credentials
• Any damages resulting from your use of the service
• Verifying that content you download is safe and legal

5. Prohibited Content

You may not upload, share, or distribute content that:

• Is illegal, harmful, or violates any law
• Infringes intellectual property rights
• Contains malware, viruses, or malicious code
• Is defamatory, obscene, or objectionable
• Violates privacy or data protection laws
• Constitutes spam or unsolicited commercial content

VIOLATION MAY RESULT IN IMMEDIATE ACCOUNT TERMINATION WITHOUT NOTICE.

6. Content Removal

We reserve the right to remove any content at any time for any reason or no reason, without notice or liability. This includes but is not limited to:

• Content that violates these terms
• Content we deem inappropriate or harmful
• Content that exceeds storage limits
• Expired content based on TTL settings
• Content flagged by automated security systems

7. Data Loss

WE ARE NOT RESPONSIBLE FOR ANY DATA LOSS. Files may be deleted due to:

• Expiration (TTL)
• System failures or errors
• Security incidents
• Maintenance or upgrades
• Service discontinuation
• Account termination

ALWAYS MAINTAIN YOUR OWN BACKUPS. We provide no data recovery services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, revenue, data, or business opportunities
• Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim (which may be $0)
• We are not liable for third-party content, actions, or claims
• We are not liable for security breaches or unauthorized access beyond our control

9. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS OpenSSD, its operators, affiliates, and personnel from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your content or activities
• Your violation of these terms
• Your violation of any laws or third-party rights
• Any claims by third parties related to your content

10. Account Termination

We may terminate or suspend your account at any time, for any reason, without notice or liability. Grounds for termination include but are not limited to:

• Violation of these terms
• Suspicious or fraudulent activity
• Complaints from third parties
• Inactivity
• Service discontinuation

Upon termination, all your data may be immediately and permanently deleted without recovery option.

11. Third-Party Services

We may integrate with third-party services (OAuth providers, etc.). We are not responsible for:

• Third-party service availability or functionality
• Third-party terms, policies, or practices
• Data shared with third-party services
• Third-party security or privacy

12. Security

While we implement security measures, WE MAKE NO GUARANTEES regarding security. We are not liable for:

• Unauthorized access or data breaches
• Intercepted transmissions
• Malicious attacks
• Vulnerabilities or exploits

USE ENCRYPTION AND PASSWORDS FOR SENSITIVE DATA.

13. Intellectual Property

You retain ownership of your content. By uploading, you grant us a non-exclusive, worldwide, royalty-free license to store, transmit, and display your content solely for providing the service.

You represent and warrant that you have all necessary rights to upload and share your content.

14. DMCA Compliance

We respond to valid DMCA takedown notices. See our DMCA Policy for details. Repeat infringers will have their accounts terminated.

15. Export Controls

You are responsible for compliance with all export control and sanctions laws. Do not use this service to export controlled materials or to sanctioned countries/entities.

16. Modifications to Service

We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time without notice or liability.

17. Governing Law

These terms shall be governed by applicable local laws. Any disputes shall be resolved in courts of competent jurisdiction.

18. Severability

If any provision is found unenforceable, the remaining provisions shall remain in full effect.

19. No Agency

No agency, partnership, joint venture, or employment relationship is created by these terms.

20. Entire Agreement

These terms constitute the entire agreement and supersede all prior agreements or understandings.
