DMCA Copyright Policy

1. Overview
OpenSSD respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This policy outlines our procedures for handling copyright infringement claims.
2. DMCA Safe Harbor
We operate as a service provider under DMCA Safe Harbor provisions. We:
- Do not pre-screen user content
- Respond promptly to valid DMCA notices
- Terminate repeat infringers
- Implement a notice-and-takedown procedure
3. User Responsibility
YOU ARE SOLELY RESPONSIBLE FOR ENSURING:
- You own or have rights to upload content
- You have obtained necessary licenses and permissions
- Your content does not infringe third-party copyrights
- Content shared via your account or links complies with copyright law
Uploading copyrighted material without authorization is prohibited and may result in account termination and legal liability.
4. Filing a DMCA Takedown Notice
4.1 Requirements
To file a valid DMCA notice, you must be the copyright owner or authorized agent. Your notice must include:
- Identification of the copyrighted work:
- Detailed description of the work
- Registration number (if registered)
- Link to original work or sample
- Identification of infringing material:
- Complete URL(s) to the infringing files
- File ID(s) if known
- Sufficient detail to locate the material
- Your contact information:
- Full legal name
- Mailing address
- Telephone number
- Email address
- Good faith statement:
"I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law." - Accuracy statement:
"The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or authorized to act on behalf of the owner." - Physical or electronic signature
4.2 How to Submit
Send DMCA notices to:

4.3 Incomplete Notices
Incomplete or invalid notices will be rejected. We will not take action on notices that lack required information or proper signatures.
5. Our Response to Valid Notices
Upon receiving a valid DMCA notice, we will:
- Expeditiously remove or disable access to the allegedly infringing material
- Notify the uploader that content was removed (if contact information available)
- Record the infringement against the user's account
- Terminate repeat infringers (see Section 9)
6. Counter-Notification (DMCA Counter-Notice)
6.1 When to File
If you believe content was removed in error or misidentification, you may file a counter-notice.
6.2 Requirements
Your counter-notice must include:
- Your contact information:
- Full legal name
- Mailing address
- Telephone number
- Email address
- Identification of removed material:
- URL or file ID
- Description of material
- Good faith statement:
"I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification." - Consent to jurisdiction:
"I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or if outside the U.S., any judicial district in which the service provider may be found), and I will accept service of process from the person who provided the original DMCA notification or an agent of such person." - Physical or electronic signature
6.3 Counter-Notice Process
Upon receiving a valid counter-notice:
- We will forward it to the original complainant
- If the complainant does not file a court action within 10-14 business days, we may restore the content
- We are not obligated to restore content and may permanently remove it at our discretion
7. Misrepresentation
WARNING: Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents:
- That material is infringing, or
- That material was removed or disabled by mistake
Shall be liable for damages including costs and attorney's fees incurred by the alleged infringer or the service provider.
DO NOT FILE FALSE DMCA NOTICES. We may pursue legal action against those who abuse the DMCA process.
8. Not Legal Advice
This policy is informational only and does not constitute legal advice. Consult an attorney for legal guidance regarding copyright infringement or DMCA notices.
9. Repeat Infringer Policy
9.1 Three Strikes
We maintain a three-strikes policy:
- First violation: Content removed, warning issued
- Second violation: Content removed, account suspended temporarily
- Third violation: PERMANENT ACCOUNT TERMINATION
9.2 Severe Violations
Mass copyright infringement or egregious violations may result in immediate permanent termination without warning.
9.3 No Appeal
Termination decisions are final. We do not guarantee appeals or account restoration.
10. Limitations
10.1 No Obligation to Monitor
WE ARE NOT OBLIGATED TO:
- Monitor content for infringement
- Proactively seek infringing material
- Verify the validity of DMCA notices
- Mediate disputes between parties
10.2 No Liability
WE ARE NOT LIABLE FOR:
- User-uploaded infringing content
- Good faith removal of content pursuant to DMCA notices
- Restoring content pursuant to counter-notices
- Terminating accounts for repeat infringement
- Failing to detect or remove infringing content
11. Preservation of Evidence
We may preserve content and user information when served with valid legal process or DMCA notices. Preserved information may be disclosed to courts, law enforcement, or parties in litigation.
12. International Copyright
This policy primarily addresses U.S. copyright law. International users should comply with their local copyright laws. We may respond to valid takedown requests under other jurisdictions' copyright laws at our discretion.
13. Other Intellectual Property
While this policy addresses copyright, we also prohibit:
- Trademark infringement
- Trade secret misappropriation
- Patent infringement
- Right of publicity violations
Report non-copyright IP violations through our support channels.
14. Modifications
We reserve the right to modify this policy at any time. Check the "Last Updated" date for changes.
⚖️ IMPORTANT: Only upload content you own or have explicit permission to share. When in doubt, don't upload it. Copyright infringement can result in legal liability, account termination, and statutory damages.
